Criminal case - Sentencing Guidelines. Nolo contendere plea to Florida
lewd and lascivious charge, which resulted in a finding of guilt with
adjudication withheld, qualified as a prior conviction for purposes of 18
U.S.C. Sec. 2252A(b)(2)'s mandatory minimum ten-year sentence;
district court erred in not considering the Guidelines in setting
defendant's sentence and the case is remanded for further sentencing
proceedings under Booker.
