U.S. Court of Appeals Case No: 04-2898
Northern District of Iowa
[PUBLISHED] [M. Arnold, Author, with Murphy and Benton, Circuit
Judges]
Criminal case - Sentencing Guidelines. Defendant admitted the facts
used to calculate drug quantity, and the district court did not err in using
this information to set the applicable sentencing range under Guidelines
Sec. 2D1.1; district court anticipated the Booker decision and properly
treated Guidelines as advisory; court methodically evaluated the
provisions of 18 U.S.C. 3553(a) in setting sentence, and defendant failed
to rebut the presumption that the sentence was reasonable.
