U.S. Court of Appeals Case No: 04-2902
Eastern District of Missouri
[PUBLISHED] [Smith. Author, with Arnold and Beam, Circuit Judges]
Civil case - civil rights. Jurors stated they were able to be impartial, and
the district court did not err in denying plaintiff's motion to strike them
for cause; given the peculiar racial backdrop of this case, the district court
did not err in denying three of plaintiff's proposed peremptory challenges
on the ground that they were not race-neutral as required by Batson.
Judge Beam, dissenting.
