Civil case - Labor Law. District court erred in granting Local 1
judgment as a matter of law on plaintiff's claim that Local 1's picketing
violated Section 303of the Labor Management Relations Act; plaintiff
presented sufficient evidence for a reasonable jury to find that Local 1
engaged in unlawful secondary activity on plaintiff's projects at a local
college and school district, and the evidence was sufficient to prove that
the unlawful activity proximately caused damages to plaintiff by delaying
the completion of the projects; district court did not err in dismissing
plaintiff's defamation claims against Local 1because the statements in
question were not defamatory under Missouri law; district court also
erred in granting Local 1 judgment as a matter of law on claim Local 1
violated plaintiff's president's privacy by hiring private investigators to
watch his home, as the evidence was sufficient to create a jury issue as to
whether Local 1 committed the tort of unreasonable intrusion on the
seclusion of another.
