U.S. Court of Appeals Case No: 04-3079
and No: 04-3142
Western District of Missouri
[PUBLISHED] [Colloton, Author, with Arnold and McMillian, Circuit Judges]
Criminal case - criminal law. Defendant consented to a search of his
vehicle, and drugs found in auxiliary gas tank were admissible; assuming,
arguendo, that certain of the prosecutor's comments in opening statement
concerning defendant's flight after arrest were improper, the general fact
of his flight was admissible, and the effect of these statements was
minimal, especially in light of the strong evidence of defendant's guilt;
the government's expert's testimony regarding defendant's "unknown
courier" defense was admissible; case remanded for resentencing under
Booker.
