U.S. Court of Appeals Case No: 04-3123
and No: 04-3228
Eastern District of Missouri
[PUBLISHED] [Smith, Author, with Loken, Chief Judge and Beam,
Circuit Judge]
Criminal case - criminal law. In prosecution for felon in possession of
a firearm, district court did not err in admitting evidence of defendant's
1987 robbery and firearms convictions, as the evidence was admissible
under 404(b) because it was material and involved an incident similar in
kind and not too remote in time; further, the district court gave a proper
limiting instruction, minimizing any prejudice; district court erred in not
sentencing defendant as an armed career criminal, as his prior offenses
were violent felonies which met the requirements for such a sentence.
