U.S. Court of Appeals Case No: 04-3205
and No: 04-3251
and No: 04-3248
District of Minnesota
[PUBLISHED] [Murphy, Author, with M. Arnold and Benton, Circuit
Judges]
Criminal case - Criminal law. Investigative stop was reasonable in
duration and scope and did not turn into a de facto arrest; defendants
voluntarily consented to a search of their apartment; district court did not
err in admitting firearms evidence as it was relevant to prove participation
in a conspiracy; no error in permitting government's chemist to testify
that the methamphetamine seized at two different locations could have
originated from the same batch; evidence was sufficient to support
convictions for conspiracy, aiding and abetting, and maintaining a drug
house; counts were properly joined.
