Criminal case - Sentencing Guidelines. Imposition of a three-level
enhancement under Guidelines Sec. 2L1.1(b)(5) was not error and did not
expose defendant to a sentence in excess of the statutory maximum; any
Booker error in imposing the enhancement was harmless; district court
did not err in refusing to grant a downward departure for minor or
minimal role in the offense as defendant was actively involved in the
crime and was an equal partner with his co-defendant.
