Criminal case - Sentencing Guidelines. It is not harmless error to
sentence a defendant under a mandatory federal sentencing guidelines
regime, as opposed to the Booker advisory system, when there is no Sixth
Amendment issue as the guideline computation and the defendant is
sentenced at the bottom of the guideline range. Case remanded for
resentencing. Judge Heaney, concurring in the result.
