Civil Case - diversity product liability. Grant of summary judgment to
die changer manufacturer on defective-design claim is reversed, as
testimony was presented that die changer was defective and unreasonably
dangerous and a safety design modification was available. The district
court erred in concluding the manufacturer is not responsible for
providing safety safeguards. The district court correctly granted summary
judgment on duty-to-warn claim. Judge Lay dissents on the duty-to-warn
claim.
