Habeas Case - death penalty. Motions for relief from judgment filed after
habeas petition but before separate judgment were properly construed by
the district court as successive habeas petitions. Ineffective assistance
does not change what constitutes a second or successive habeas. An
amendment to a petition is not successive if it occurs after the petition
is denied but before the denial is affirmed on appeal. A Rule 59(e) motion
cannot be used to raise new claims.
