Criminal Case - criminal law. District court did not err in dismissing indictment on statute of limitations grounds. Indictment charged defendant with abusive acts between 1988 and 1992. Under 5-year statute of limitations, government had until 1993 to charge for the earliest conduct. Section 3509(k), enacted in 1990, and recodified as section 3283, extended statute before prosecution was barred and does not violate ex post factor clause.
