U.S. Court of Appeals Case No: 04-3521
Eastern District of Missouri
[PUBLISHED] [Loken, Author, with Beam and Melloy, Circuit Judges]
Civil case - Lanham Act. Plaintiff failed to state a Lanham Act
violation in its claim that the Yellow Book was violating the Act by
listing general dentists under the categories "Dentist-Orthodontist" and
"Orthodontist (Straightening Braces)"; even if the complaint did state a
claim, plaintiff lacked standing to assert a false advertising claim against
Yellow Book, which was the advertising medium, not the advertiser.
