U.S. Court of Appeals Case No: 04-3576
Western District of Missouri
[PUBLISHED] [Melloy, Author, with Loken, Chief Judge, and Beam,
Circuit Judge]
Civil case - Insurance. Vehicle involved in collision with plaintiffs'
vehicle did not qualify as an uninsured vehicle under their policies
because National Car Rental, the owner of the vehicle, was self-insured
and was required by operation of Missouri law to provide the required
minimum insurance; National Car Rental's offered to pay the sum
required to meet the minimum insurance, and its claim that it was not the
primary insurer was not a denial of coverage; National's bankruptcy had
no effect on the question as the bankruptcy court approved payment of
the offer; however, the car did qualify as an underinsured vehicle under
plaintiffs' policies; plaintiffs may not stack the underinsured motorist
provisions of their multiple policies.
