U.S. Court of Appeals Case No: 04-3601
Northern District of Iowa
[PUBLISHED] [Bye, Author, with John R. Gibson and Gruender,
Circuit Judges]
Criminal case - criminal law. While defendant voluntarily consented to
a search of his person, the district court erred in finding he did not
unequivocally withdraw that consent before the drugs in question were
discovered; defendant's attempts to block the officers' efforts to search
his pockets would have alerted a reasonable observer that he had
withdrawn his consent. Judge Gruender, dissenting.
