U.S. Court of Appeals Case No: 04-3606
Eastern District of Arkansas
[PUBLISHED] [Melloy, Author, with Loken, Chief Judge, and Hansen,
Circuit Judge]
Civil case - Employment discrimination. Defendant established a
legitimate, non-discriminatory reason for its promotion decision, and
plaintiff failed to show the reason was a pretext for race discrimination;
similarly, plaintiff failed to show that the legitimate, non-discriminatory
grounds for salary differences between her and two white employees were
pretexts for discrimination; transfer did not constitute a constructive
discharge; transfer to another position was not an adverse employment
action in that the new position was considered a higher-level position and
came with a raise, and the transfer did not constitute retaliation.
