U.S. Court of Appeals Case No: 04-3610
District of South Dakota
[PUBLISHED] [Wollman, Author, with Bright and Bye, Circuit
Judges]
Criminal case - Sentencing Guidelines. Government breached the plea
agreement by not moving for an additional two-level reduction after the
district court granted a two-level reduction on its own motion; however,
defendant failed to establish that he was entitled to any relief based on the
breach, as defendant did not demonstrate a reasonable probability that the
district court would have imposed a lesser sentence had the government
moved for the additional reduction level.
