Criminal Case - conviction. Sufficient evidence was presented to support
conspiracy to commit marriage fraud and aiding and abetting the
commission of marriage fraud based on defendant's solicitation of several
women to enter into green card marriages with Pakistani men for the
purpose of helping the men remain in the United States. The district
court did not abuse its discretion in denying a new trial based on the
weight of the evidence, in admitting evidence of his personal
relationships, and in admitting evidence under Rule 404(b) of his prior
solicitation of other women to marry foreign nationals and in not giving a
limiting instruction. The district court did not abuse its discretion in
denying a motion for mistrial based on prosecutorial misconduct, as there
was no Brady or Jenck Act violation, any failure to disclose witness
immunity was harmless, and defendant was not prevented from calling a
witness on his behalf. The court did not abuse its discretion in refusing
to give defendant's preferred response to the jury's question and in denying
transcripts without defendant being present. Any cummulative effect of
trial errors did not warrant a new trial.
