U.S. Court of Appeals Case No: 04-3823
Western District of Missouri
[PUBLISHED] [Benton, Author, with Loken, Chief Judge, and
Gruender, Circuit Judge]
Criminal case - Sentencing. Defendant's incest conviction involved a
minor and was a violent felony for purposes of sentencing under the
Armed Career Criminal Act; the court again rejects the argument that a
jury must determine whether a prior conviction is a violent felony; since
defendant was given the mandatory minimum sentence under the Armed
Career Criminal Act, no Booker violation occurred.
