Western District of Missouri
[PUBLISHED] [Murphy, Author, with Bowman and Gruender, Circuit Judges]
Criminal case - criminal law. District court did not err in allowing the
government to reopen its case in chief as the government reopened its
case immediately after it rested, defendants had an opportunity to cross-
examine the witness and the witness's testimony was highly probative; no
abuse of discretion in denying motion to sever; evidence was sufficient to
support convictions for felony murder, conspiracy, armed robbery and use
of firearm; district court did not abuse its discretion in denying defendant
Washington's request for new counsel for sentencing; admission of
evidence of flight was not plain error; claims of prosecutorial misconduct
rejected.
