U.S. Court of Appeals Case No: 04-3886
and No: 04-3888
and No: 04-3887
District of Minnesota
[PUBLISHED] [Wollman, Author, with Loken, Chief Judge, and Bye,
Circuit Judge]
Criminal case - criminal law. Evidence was sufficient to support
conviction for possession of altered currency; district court erred in
viewing the Sixth Amendment's limitation on the guidelines as excluding
all sentence enhancements based on the district court's own fact finding,
and the case must be remanded for further sentencing proceedings;
neither Apprendi not Blakely prohibit district court fact finding for
restitution orders; here, restitution award fell within the scope of the
indictment and is affirmed.
