granting prison officer's motion for summary judgment based on
qualified immunity in case involving claim officer failed to protect
plaintiff from attack by another prisoner because there was no evidence
the officer was deliberately indifferent to a known risk of a surprise
attack against plaintiff. Judge Lay, dissenting.
