U.S. Court of Appeals Case No: 04-3901
Southern District of Iowa
[PUBLISHED] [Murphy, Author, with Bye and Smith, Circuit Judges]
Criminal case - criminal law. District court did not err in denying
defendant's motion to exclude the government's evidence under 8 U.S.C.
Sec. 1367(a) which places certain restrictions on the use of information
about battered alien spouses; the language of the statute is clear that it
applies only to proceedings to determine immigration status and does not
apply to use of the information in criminal proceedings.
