Criminal case - criminal law. The district court acted within its
discretion by precluding the government from re-prosecuting defendant
for the greater charge included in the second superceding indictment;
however, the court erred in foreclosing re-prosecution of the charges
advanced in the first superseding indictment; re-prosecution on the first
superseding indictment did not violate the Speedy Trial Act.
