U.S. Court of Appeals Case No: 04-3916
and No: 04-4068
Eastern District of Arkansas
[PUBLISHED] [Riley, Author, with John Gibson and Colloton, Circuit Judges]
Civil case - civil rights. The only issue properly before the court in this
interlocutory appeal from an order denying defendants' motions for
summary judgment is the issue of whether the county sheriff was entitled
to qualified immunity, and all other issues are dismissed for lack of
jurisdiction; sheriff was entitled to qualified immunity as there was no
evidence he knew plaintiff's decedent had serious medical needs and
deliberately disregarded them.
