The district court did not err in admitting testimony from nine other victims of defendant's fraud, even though those acts were not charged in the indictment; admission of charts was not an abuse of discretion; court did not err in refusing to dismiss a juror defendant contended was sleeping; defendant was not entitled to Booker relief as there was no reason to believe the district court would have imposed a lesser sentence under an advisory guidelines scheme.
