U.S. Court of Appeals Case No: 04-3919
Eastern District of Missouri
[PUBLISHED] [Bye, Author, with Beam and Smith, Circuit Judges]
Criminal case - criminal law. The district court did not err in admitting
testimony from nine other victims of defendant's fraud, even though
those acts were not charged in the indictment; admission of charts was
not an abuse of discretion; court did not err in refusing to dismiss a juror
defendant contended was sleeping; defendant was not entitled to Booker
relief as there was no reason to believe the district court would have
imposed a lesser sentence under an advisory guidelines scheme.
