U.S. Court of Appeals Case No: 04-3936
Western District of Missouri
[PUBLISHED] [Gruender, Author, with Loken, Chief Judge, and
Benton, Circuit Judge]
Criminal case -Sentencing. District court did not err in finding that
defendant's Missouri state conviction for tampering with a motor vehicle
was a crime of violence for sentencing purposes; district court's use of
mandatory sentencing guidelines was harmless error in light of the court's
pronouncement of an identical alternative sentence.
