U.S. Court of Appeals Case No: 04-3955
Eastern District of Missouri
[PUBLISHED] [Colloton, Author, with Riley and John Gibson, Circuit Judges]
Civil case - civil rights. District court did not err in granting
defendants' motion for summary judgment in case arising out of search of
the wrong apartment because plaintiff failed to show that the police did
not have probable cause to search the apartment at the time the warrant
was issued or that they unreasonably relied on the warrant when they
conducted the search; it was permissible to detain plaintiff while the
police conducted a reasonable search of the apartment; district court did
not err in quashing subpoena seeking information regarding the City of
St. Louis prosecutor's decision not to prosecute the man whom they
police were investigating at the time of the search.
