U.S. Court of Appeals Case No: 04-4013
and No: 05-1065
Eastern District of Arkansas
[PUBLISHED] [Bye, Author, with Murphy and Smith, Circuit Judges]
Criminal case - criminal law. Evidence was sufficient to support
convictions for conspiring to injure judicial officers in their property
through creation of bogus UCC financing statements; evidence was also
sufficient to support conviction for corruptly endeavoring to intimidate a
judicial officer in the discharge of her official duties; no error in denying
motion to sever co-defendants; district court did not err in refusing to
give requested instruction on the defense of legal impossibility as the
objective of the scheme was factually, but not legally impossible;
enhancement under Guidelines Sec. 3A1.2 based on victim's official
status was not double counting.
