U.S. Court of Appeals Case No: 04-4018
District of Minnesota
[PUBLISHED] [Bye, Author, with Loken, Chief Judge, and Smith, Circuit Judge]
Criminal case - Sentencing Guidelines. District court correctly
interpreted and applied the enhancement for means of identification;
under the harmless error standard applied when a defendant preserves a
Blakely/Booker error, defendant was not entitled to resentencing because
nothing in the record showed the district court would have imposed a
shorter sentence under an advisory guidelines system.
