Criminal Case - conviction. District court did not abuse its discretion in
determining no conflict of interest existed when counsel, who represented
defendant in prior state proceeding, represented codefendant before
defendant was charged. Finding that counsel's representation of
codefendant was effectively completed before defendant was involved
and finding that counsel and the government possessed no information
from prior state representation are not clearly erroneous. Thus,
conviction may not be overturned based on a conflict of interest.
