U.S. Court of Appeals Case No: 04-4073
Western District of Missouri
[PUBLISHED] [Benton, Author, with Loken, Chief Judge, and Lay,
Circuit Judge]
Civil case -civil rights. District court did not err in denying defendant's
motion for summary judgment based on his claim of absolute privilege as
the evidence did not show that he was acting within the scope of his
official duties when he made the statement at issue; nor was he entitled to
assert the absolute privilege given to statements related to judicial and
quasi-judicial proceedings as administrative proceedings were not
anticipated at the time of the statement; grant of partial summary
judgment was not appealable.
