U.S. Court of Appeals Case No: 04-4110
Eastern District of Missouri
[PUBLISHED] [Benton, Author, with Heaney and Smith, Circuit Judges]
Criminal case - Criminal law and sentencing. Evidence was sufficient
to support conviction for passing counterfeit checks; government's failure
to provide organizational victim disclosure statement under Fed. R. Crim.
P. 12.4(b) did not prejudice defendant and was not a reversible error;
admission of prior bad acts evidence was proper; admission of tape
recorded conversations was not error; jury instruction on aiding and
abetting was not erroneous; defendant was not entitled to Booker relief as
he could not demonstrate a reasonable probability that the district court
would have imposed a lesser sentence under an advisory guidelines
scheme.
