U.S. Court of Appeals Case No: 04-4123
and No: 04-4128
Eastern District of Arkansas
[PUBLISHED] [Benton, Author, with Smith and Heaney, Circuit Judges]
Civil case - employment discrimination. Record supported jury's
finding that plaintiff was disabled for ADA purposes, as his anxiety and
depression substantially limited his ability to think and concentrate
compared to the average person; there was also sufficient evidence in the
record to support the jury's finding that UPS failed to engage in good-
faith interactive process with plaintiff to determine whether he could
perform his job with or without reasonable accommodation; evidence
also showed that a reasonable accommodation was available; district
court did not err in granting UPS summary judgment on plaintiff's FMLA
claim as he could not perform the essential functions of his job when he
first sought to return to work; district court did not err in granting
judgment as a matter of law to UPS on plaintiff's request for punitive
damages.
