044151P.pdf 08/01/2005 United States v. Denise M. Henderson
U.S. Court of Appeals Case No: 04-4151
   District of Minnesota
[PUBLISHED] [Benton, Author, with Riley and Bowman, Circuit Judges] Criminal case - criminal law. Evidence was sufficient to support convictions for wire fraud and Social Security fraud; district court did not err in refusing to dismiss or stay the criminal case in deference to parallel administrative proceedings before the Social Security Administration; challenge to indictment rejected; evidence of defendant's business and travel activities and her participation in pageants was relevant to show she misrepresented her condition and was properly admitted; court's instruction on materiality of defendant's statements was proper; court's decision to impose an enhancement for obstruction of justice was harmless error as the sentence imposed fell within the guideline range which would have applied without the enhancement; search warrant was not overbroad.
