U.S. Court of Appeals Case No: 05-1013
Southern District of Iowa
[PUBLISHED] [Benton, Author, with Melloy and Beam, Circuit Judges]
Criminal case - criminal law and sentencing. Evidence was sufficient
to support firearms conviction; no error in giving an Allen charge when
jury indicated it was at an impasse after four hours of deliberation; no
error in giving a supplemental instruction defining "knowingly;" any
Booker error was harmless in that the court specifically stated it was
rejecting a lower sentence as a "disservice to society," in light of
defendant's extensive criminal history.
