U.S. Court of Appeals Case No: 05-1101
and No: 05-2075
and No: 05-2065
Eastern District of Missouri
[PUBLISHED] [Colloton, Author, with Riley, Circuit Judge, and Kyle,
District Judge]
Civil Case - enforcement of settlement. District court did not err in
denying motion to remand, as removal was timely. District court did not
clearly err in finding parties had meeting of minds concerning terms of
settlement and attorney had authority to settle on behalf of corporation.
Sanction order was sufficiently clear and specific, but district court
abused its discretion in imposing monetary sanction and case is remanded
to specify basis for monetary sanction.
