U.S. Court of Appeals Case No: 05-1174
Eastern District of Missouri
[PUBLISHED] [M. Arnold, Author, with Loken, Chief Judge, and
Colloton, Circuit Judge]
Criminal case - Sentencing Guidelines. Under the law of this circuit,
theft of an auto qualifies as a crime of violence, and the district court did
not err in imposing an enhancement under Guidelines Section

jury; applying Pirani's plain error analysis, defendant was not entitled to
Booker relief.
