U.S. Court of Appeals Case No: 05-1201
   District of Nebraska
[PUBLISHED] [Riley, Author, with John R. Gibson and Colloton, Circuit Judges]
Civil Case -Diversity - noncompete agreements. Grant of summary judgment in favor of employees subject to non-compete agreement is affirmed, as district court properly concluded Nebraska law should apply because it has a greater material interest than Ohio and Ohio law is contrary to fundamental policy of Nebraska of rejecting judicial reformation of noncompete agreements. District court also properly concluded the noncompete agreements were overbroad and unenforceable.
