U.S. Court of Appeals Case No: 05-1253
District of Nebraska
[PUBLISHED] [Loken, Author, with Wollman and Bye, Circuit Judges]
Criminal case - criminal law. Claim that prosecutorial misconduct
during defendant's cross-examination required a mistrial rejected, as the
prosecutor had a good faith basis to believe questions about defendant's
prior conviction were permissible under Rule 609 and because the court
promptly sustained defendant's objections and instructed the jury to
disregard the questions; claim of prosecutorial misconduct during closing
argument rejected.
