U.S. Court of Appeals Case No: 05-1467
District of Minnesota
[PUBLISHED] [Bye, Author, with Arnold and Melloy, Circuit Judges]
Habeas Case - state habeas corpus. District court's denial of
habeas relief is affirmed. State court's misapplication of state
law is not grounds for federal habeas relief and defendant did not
meet burden of showing use of false testimony was contrary to or
involved an unreasonable application of clearly established federal
law. Evidence that officer prompted one witness's identification was
not material and thus no Brady violation resulted from withholding
evidence from defense.
