U.S. Court of Appeals Case No: 05-1555
District of Minnesota
[PUBLISHED] [Murphy, Author, with Arnold and Hansen, Circuit Judges]
Criminal case - criminal law. In a prosecution for bank robbery, the
district court did not err in admitting evidence concerning defendant's
prior bank robbery convictions, as the crimes were similar in nature and
were only separated by seven years; even if admission of the evidence
was error, it was harmless error in light of the overwhelming evidence of
defendant's guilt; district court did not err in sentencing defendant as a
career offender because his prior conviction for aiding and abetting the
burglary of a school building was a crime of violence for purposes of
Guidelines Section 4B1.2(a).
