U.S. Court of Appeals Case No: 05-1557
District of Minnesota
[PUBLISHED] [Murphy, Author, with Bright and Gruender, Circuit Judges]
Criminal case - criminal law. District court did not err in admitting
certified copy of defendant's prior conviction for making threats against
the victim of this offense; Molotov cocktails are quasi suspect in nature
and the district court did not err in instructing the jury on knowing
possession rather than specific intent; defendant was not entitled to an
instruction based on impossibility of registering a Molotov cocktail, as
the law of this circuit is that even if a device cannot be registered, an
individual can still comply with the law by not taking possession of it.
