U.S. Court of Appeals Case No: 05-1576
and No: 05-1577
District of South Dakota
[PUBLISHED] [Smith, Author, with Bye and Beam, Circuit Judges]
Criminal case - criminal law and sentencing. Evidence was sufficient to
support conspiracy and distribution convictions; no error in admitting
evidence concerning possession of methamphetamine paraphernalia as
the possession of the items tended to prove defendant knew the drugs in
his possession were methamphetamine; reference to "prior felonies" was
cured by a limiting instruction.
