U.S. Court of Appeals Case No: 05-1598
Eastern District of Missouri
[PUBLISHED] [Smith, Author, with Heaney and Benton, Circuit Judges]
Civil case- Environmental law. District court did not abuse its
discretion in denying Rule 59(e) motion to set aside a consent decree in
a CERCLA case; Mallinckrodt failed to provide a persuasive explanation
for its failure to produce the evidence before the hearing on the consent
decree and all of the evidence contained in the report Mallinckrodt sought
to introduce was available prior to entry of judgment; district court did
not err in denying Rule 60(b)(3) motion.
