U.S. Court of Appeals Case No: 05-1641
   Southern District of Iowa
[PUBLISHED] [Smith, Author, with Bye and Beam, Circuit Judges] Civil case - Arbitration. District court erred in finding the transportation worker exemption in Section of the Federal Arbitration Act applied to plaintiff, a customer service representative, as plaintiff's duties were not so closely related to interstate transportation that he had to be considered as a transportation worker; as a result, the district court erred in denying defendant's motion to compel arbitration of the underlying employment dispute.
