U.S. Court of Appeals Case No: 05-1644
and No: 05-1812
Northern District of Iowa
[PUBLISHED] [Gruender, Author, with Bowman and Bye, Circuit Judges]
Criminal case - Criminal law and sentencing. The government did not
contest adjustment for acceptance of responsibility, and there was no
breach of defendant's plea agreement; sentencing enhancements need
only be proven by a preponderance of the evidence; district court did not
err in imposing a three-level upward adjustment for management role in
the offense, nor did the court err in declining to grant a downward
departure for substantial assistance and overstated criminal history;
sentences imposed against defendants are reasonable.
