051715P.pdf 11/29/2005 Ronald Scarberry v. State of Iowa
U.S. Court of Appeals Case No: 05-1715
   Southern District of Iowa
[PUBLISHED] [Bowman, Author, with Arnold, and Murphy, Circuit Judges]
Prisoner case - habeas case. District court erred in granting habeas relief on Scarberry's claims of ineffective assistance of counsel; Iowa courts did not unreasonably apply Strickland in concluding that the performance of Scarberry's trial and appellate counsel was not professionally unreasonable when counsel failed to invoke the Sixth Amendment in challenging the admission of Scarberry's statements; alternatively, if counsel's actions were erroneous, the error did not prejudice Scarberry because the evidence of his guilty was compelling even without the challenged evidence.
