Criminal case - Criminal law. Items seized from defendant's person
after his arrest were admissible; no error in admitting evidence defendant
carried a false ID card; evidence was sufficient to support defendants
Alexander's and Brown's convictions for conspiracy and possession of
PCP and cocaine with intent to distribute; no error in denying motion for
new trial based on newly discovered evidence as the evidence, at best,
was impeachment material; fact of a prior conviction is a sentencing
factor to be found by the district court and is not a fact issue to be found
by the jury; mandatory minimum sentence did not violate the Eighth
Amendments's prohibition on cruel and unusual punishment; evidence
was sufficient to support defendants Alexander's and Alexander-Butler's
convictions for conspiracy to commit wire fraud.
