U.S. Court of Appeals Case No: 05-1755
Northern District of Iowa
[PUBLISHED] [Murphy, Author, with Arnold and Gruender, Circuit Judges]
Criminal case - criminal law. Officers followed department policy
when they impounded defendant's car and inventoried its content, and the
items found during the search were admissible; alternatively, officers had
probable cause to search vehicle and search was incident to a lawful
arrest; single remark about defendant's prior theft conviction was grounds
for a mistrial, as the remark had little effect, the evidence was
overwhelming and any prejudice was cured by the trial court's curative
instruction; limits on cross-examination of jailhouse informant were not
an abuse of the court's discretion.
